The New South Wales (NSW) Government has announced new water efficiency standards for rental properties, aiming to reduce water consumption and promote sustainability. Landlords are urged to familiarise themselves with these requirements to ensure compliance and avoid financial penalties.


Under the updated regulations, which come into effect on 23 March 2025, landlords must upgrade rental properties to meet specific water efficiency standards to pass water usage charges to tenants. These changes include mandatory upgrades to dual-flush toilets and ongoing maintenance obligations.


Key Changes to Water Efficiency Requirements

The primary update requires that all toilets in rental properties be dual-flush models with a minimum three-star rating under the Commonwealth Water Efficiency Labelling and Standards (WELS) scheme. This upgrade ensures that rental properties contribute to water conservation efforts while providing tenants with modern, efficient facilities.


Additional Responsibilities for Landlords

The new standards build on existing water efficiency requirements introduced in 2020. Landlords will also need to:

  • Inspect all taps and toilets for leaks at the start of each new tenancy and after water efficiency-related repairs or upgrades.

  • Ensure compliance with these inspections throughout each tenancy period.
